How the councils here work — the numbers first

Most Hawke's Bay projects touch one of two city/district councils, plus Hawke's Bay Regional Council if water, discharges or earthworks are involved. All figures come from each council's published fees schedule — they change every July, they're indicative, and base fees or deposits are initial charges with actual costs billed on top at hourly rates.

The gap that matters most is notification: a publicly notified consent in Hastings starts at a $20,000 lodgement fee, so getting affected-party sign-off early is the cheapest consenting decision you'll make here. Napier at least offers a free first hour of pre-application advice; Hastings charges $500 for a pre-application meeting.

Cyclone Gabrielle recovery — consenting under emergency law

Cyclone Gabrielle (February 2023) still shapes the region's consent workload. 287 residential properties were confirmed Category 3 — 265 in Hastings and 22 in Napier — bought out under a voluntary Crown/council programme at pre-cyclone market value.

For construction, the bigger deal is the Severe Weather Emergency Recovery legislation. The Hawke's Bay Flood Protection Works Order gives flood-protection projects at eight locations — including Wairoa, Waiohiki, Pākōwhai and Awatoto — a streamlined controlled-activity consenting pathway with no appeals, running to 31 March 2028. (A separate Rural Recovery Works Order covering permitted-activity repairs for rural landowners ran to April 2026.) If your project touches recovery works, the consenting track may be faster and different from the standard RMA path — we check which regime applies before scoping anything.

Napier: a plan in transition and art-deco heritage

Napier is mid-plan-review, which means the 2011 Operative District Plan and the Proposed District Plan both carry legal weight — the Appeals Version was released in February 2026. Two things matter for applicants:

  • Heritage. The new plan protects Napier's renowned art-deco and early-suburb character through heritage character precincts — the Marewa Art Deco Character Zone, Te Awa Bungalow Character Zone, Marewa State Housing Character Zone and a new Napier South Heritage Character Precinct — with controls on demolition, exterior alterations, garages in front of dwellings, fences and lot sizes. In these precincts, check the character rules before you design, not after.
  • Hazards. New rules address flooding, liquefaction and coastal hazards — the geography Gabrielle exposed. Napier is a Tier 1 urban council, so national intensification rules flow through the new plan.

Hastings: the versatile-soils wall

Hastings' signature constraint is the Plains Production Zone, protecting the Heretaunga Plains' versatile soils — Class 1, 2 and 3e soils that cover about 55% of the Plains and are described in the district plan as nationally significant for cropping, viticulture and orcharding. Retaining that land for production is a stated cornerstone of the council's sustainability policy, which makes rural lifestyle subdivision on the Plains one of the hardest consent asks in the region. Even the Class 7 Gimblett Gravels (about 7% of Plains soils) have "terroir status", with a Roys Hill Winegrowing District overlay.

The flip side is Plan Change 5, "Right homes, right place" — residential intensification inside the existing urban area (medium-density zoning, 12 m height limits) expressly designed to keep sprawl off the Plains. If you're subdividing rural land near Hastings or Havelock North, expect the soils question to dominate; if you're intensifying inside the city, the path is clearer than it used to be.

Water: TANK and the "sinking lid"

If your project takes or uses water, Hawke's Bay Regional Council's TANK plan change (covering the Tūtaekurī, Ahuriri, Ngaruroro and Karamū catchments) is now the rulebook — the consent-order version issued in April 2026 has legal effect. Water is allocated on Actual and Reasonable Use — broadly, your highest annual use in the ten years before May 2020 — and the council is explicit that many consent holders will not be re-allocated the same volume as before. With the Heretaunga aquifer (460 km², around 1,700 consents) under an interim groundwater allocation limit of 90 million m³ a year, replacement water-take consents need careful evidence. This is specialist work, and we coordinate it alongside your district consent.

Corridor access: two very different systems

  • Napier lodges CARs through beforeUdig, with fees tiered by duration: an excavation CAR is $766 for up to 10 days, $1,532 for 11 days to 6 months, and $3,064 for 6–12 months (non-excavation up to 10 days is $307; extra inspections $177 each). A TMP must accompany the CAR.
  • Hastings is the outlier: only Council Approved Contractors may work in the road reserve, and vehicle crossings can only be built by registered approved contractors who lodge the CAR on the owner's behalf. Fees are a $486 CAR application plus $127 TMP approval, with inspections at $128 an hour (2026/27 schedule). If your usual crew isn't on the approved list, have that conversation before the programme is set.
